Assalamu Alaikum.
I am one of those persons who were consulted in drafting the Statement about Apostasy.
I was a member of the Editorial Board of Bidhiboddho Islami Ain (Codified Islamic Law) published by Islamic Foundation of Bangladesh. This book is an up-to-date compilation of Hanafi Fiqh. Since it is all too well-known that it is the traditional opinion, including of Hanafi Fiqh, that apostasy is punishable by death, this position is included in that book. Thus, those who are familiar with that book and are aware that I was a member of the editorial board, it might be thought that I also hold the same position on punishment of apostasy as it is stated there.
I want to take this opportunity to clarify that Bidhiboddho Islami Ain, produced and published by Islamic Foundation, Dhaka, is basically a codification of Hanafi views on fiqh. At places it has taken other fiqh views as well. It has also expanded the law where Hanafi or classical fiqh have not elaborated. One can say that it is a modern day Fatwae Alamgiri with a sort of modern system of chapter planning, arranging them section-wise or article-wise. It was not possible for the group of authors ( in fact compilers/editors ) to depart drastically from classical position on any issue. This book is useful as an easy reference of classical position and some new views where the authors agreed.
I have never written in any of my own writings that apostasy is punishable by death. On this issue of punisment of apostasy I hold the same view as that of Dr. Jamal Badawi, Dr. Hashim Kamali, Dr. AbdulHamid AbuSulayman and such scholars. Those who are familiar with my activities have seen how I have forwarded all the articles/interviews of scholars who hold that apostasy has no punishment unless in conjunction with rebellion or violence. This is my view.
